Denial of visitation rights for a child

23-Jan-2023 (In Child Custody Law)
Hi, my story goes as.. I am separated from husband since 8years. Currently, we have signed for mutual consent terms. However in the consent terms, visitation rights of the child have been given to the father. I do not want the child access or any kind of visitation rights to be given Bcoz it is in the best interest of the child. In all these 8years the father has never tried to keep any contact with the child. Hence the child does not even know who the father is. I do not want the child to undergo any pressure from the court to meet the father. Child has been brought up very well with a great family bonding. What can I do so that the court gets convinced in my favor? Father is creating a chaos for visitation rights and adamant upon visitation rights.

We need to consider following points before opening
1) as u said u have filed divorce by mutual consent , have you agreed for visiting right of father
2) is Court passed any orders thereon

If answer to above question is affirmative then u can't deny the fathers right to visit
Till the time said order is changed

When your intention was otherwise and specially in view of your apprehensions, you should not have incorporated the visitation rights in the mutual consent terms permitting the father of the child to visit the child. The only option now available to you is avoid the child from meeting the father but again there is every chance that your husband may approach the Court. If the child is not interested to meet the father then you may report the same to the Court and seek appropriate orders but do not do it immediately.

Hi at first you or anyone can't stop father from meeting his child even if he had not mate him for last 8 years. But if you can show that childs father is criminal or in jail or of bad character or so on the court will not allow him to meet or if permits than with strick instructions.
