Clarification on criteria of child custody

Age limit for the custody of children is below 18 years.
Custody of minor children depends mainly the welfare of children, court while deciding the custody of the child, opinion of minor children will be taken, if the child is above 5years, in any court will consider welfare of the minor children is paramount consideration for granting the custody.

There is nothing like fixed age limit for custody of the child. However if the child is less than 5 years old normally custody is given to mother unless it is demonstrated that mother is in capable of taking care of the child, as she is not mentally sound, she is financially incapable taking care of the child, she is leading adulterous life. It all depends upon the circumstances of each case.

Upto 5 years for boy and till 7 years for girl child the custody will be with mother. Then the husband will get visiting rights and later at the age of 13 for both children, the parents get custodial rights , I.e either the children can be with mother or father.
