Child custody and maintenance

Hi Team, My Net income is as 1,10,000 per month as a take home and my wife's take home is as 50,000 as a take home.We are going for a mutual divorce, We have married since last 8 years and we have a 7 years old son.If I need to give my son's maintenance per month, then how much I will have to give the maintenance per month. We both are qualified engineers. We both are working since last 10 years.

Dear client generally u have to give maintenance up to 25 % of yr monthly income. As u both r going for mutual divorce then decide maintenance amount mutually up to 20 I per month.For any legal help call me

Hi it is a mutual divorce you both are earning with good salary in mutual divorce it is not compulsory to give mAintenance it optional what you both discuss and decides are the term and conditions no hard and fast rules.

There is no fixed rate or parameter to decide Quantum of maintenance.
The maintenance will be decided upon basic necessities and lifestyle which you would provide your child of not separated

Dear,
usually the income of the parents is of a paramount consideration while the judges adjudicate the matter. There is no fixed formula as such, for deciding maintenance amount. The factors taken into consideration are:- Status of the parties, standard of living, basic necessities, survival, accommodation, etc. Since your wife is already earning 50,000/- it will be considered.

I would personally suggest to make a FD in the name of your child, of the amount which you think will suffice him mainly for his education and future competitive studies. If you are willing to mutually separate, then best would be to sit together and mutually evaluate the amount that may be required.

Eg:- you come to a conclusion that Rs. 15,00,000/- will be his total expense then 10,00,000/- can be paid by you and 5,00,000/- can be paid by the wife.

Dear sir
If both of u r going fr mutual divorce then both of you should maintain the child. It's equal responsibility of the parents. So if suppose X amt is required monthly required fr child maintenance inculidng education living etc then that x amount should be divided between both the parents.
