Can wife challenge visitation rights of husband ?
08-Feb-2023 (In Child Custody Law)
Can a wife prevent her husband and family from seeing their child ,saying that the husband is not earning .he was working in gulf but lost his job.
For that purpose you will have to file a divorce petition Under Section 13 of Hindu Marriage. However, you are required to prove his legitimate fault which is not possible in this case. Though, if your Husband agrees then, file for a mutual consent divorce and then apply for the custody of child Under Section 6 of Hindu Minority and Guardianship Act.
Dear Client,
You may file a Guardian OP at the family court of your area. along with a petition for visitation rights to see the child in the court. Usually the court shall allow this type of petitions and you will not have any right to take the child outside the court. You can spend time with the child for a reasonable time, later on you ask for the interim custody of the child in weeksends like that , if the child is okay with you.
