Can a mother object on father's visiting rights, if he is a criminal?

Hello, My sister is separated and is with us for the last 5yrs. She has two kids , her son is 6yrs old and daughter is 16yrs. Her husband has filled custody and restitution suit. I just want to know can we object to father's visiting rights if he is a criminal.

Yes, ofcourse we can object on father's visiting's right if he is a criminal . We need to File appropriate application for the same .

Yes mother can object to the the father visiting rights if the father is a criminal and if father has negative impact upon the upbringing of the children & if he is influencing or instigating the children against their mother.

You are asking for stopping visitation right of the father are one of the parent which is not possible in the eye of law and for this reason your efforts may go into vein... But for more details you should contact your advocate...

Yes you can very well object by way of filing a reply or at the time of arguments on the ground that the husband has a criminal record. The court will grant visitation onlyif it is in the best interests of the child.

Let us first talk about custody of the children.
Till the children attain the age of maturity i.e. 18 yrs of age, mother has the full right to keep her children with her. Law says, child must remain with mother specially in case of a FEMALE CHILD.
Secondly, if a father has been convicted, not prosecuted, can be called as a criminal.
Thirdly, if he is a criminal, that can be a ground to oppose the custody.

In nutshell, case has to fought properly but there is no sufficient ground to give custody to father. After the child attain age of 18, it is there wish and will to live with either or neither.
