Can a father get child custody of 4 months old child.

Sir/madam, My mother-in-law mentally tortured me while I was pregnant. She doesn't took me to hospital for routine check Up and my husband used to abuse me now a days. My husband try to blackmail me. He used to harm himself and demanding custody of my 4month daughter he didn't do anything for her. Can he get custody of my baby? My baby girl is the only reason why I m still alive.

God has blessed you with a baby girl and no one can take custody of your minor baby girl from you without your consent. Do your bit in taking good care of your child so that she will proud of her mother, I'm very much sure you will find more reasons to live life with your daughter.
The law governing child custody in India are the Guardianship and wards Act 1890 and The Hindu Minority and Guardianship Act 1956... plz do specify your cast a hindu or non-hindu for appropriate advice as per applicability of Law. SInce your daughter has not attained the Age of 5 years your husband has No right to custody.
The welfare and intrest of Child and not the right of parents is supreme.
