4 year old daughter's custody to mother

my husband is not living with me, he is not doing job too by his own wish, i live separately because is over abusive and violent behaviour. among my two daughters elder is living with me but younger is living with his parents sicne she was 6month old, how can i get back her custody as they never gave me her and i asked many times

You will have to seek order from the court for custody of your daughter. You are the natural and primary guardian of your daughter up to the age of 5 years. After that father may claim guardianship. You should file suit for guardianship of your daughter.

For the same you can file a case under gaurdian and wardship act before the appropriate court asking the custudy of your child on various ground provided that you must assure the court that you will keep your child in better sitution then your husband is keeping only the welfare of the child is been looked by the court at the time of giving custudy
