What is the procedure for cheque bounce case
07-Apr-2023 (In Cheque Bounce Law)
Sir, I have a credit card with 68,000 limit. I have paid minimum dues for 6 months, after that due to some financial problems i have not paid minimum dues, so the card got overdraft and now the outstanding amount is 1,00,000. The card is in write off stage. The recovery agent has forced me to pay entire amount but it is not possible for me so i paid 16000 initially, after that he asked me for a cheque for 50,000 I said it is not possible for me to pay that much amount at a time. So due to his force i have given 20,000 post dated cheque with 15th march 2017, however I have requested him not to deposit so that i can pay by hand. I have paid 10,000 on 28th march and another 10000 through online on 3rd march but the agent has deposited the cheque and now it got bounce. could you please suggest what all the consequences and how i need to face
No you can not sue bcs 30 days time period has been elapsed .with in three months from date of cheque you can present cheque any no of times.but when you recieve memo from bank with in 30 days you send notice through lawyer.
Yes definitely you can sue your customer under section 138 NIA. You have to mention reason for delay. Send him a legal notice after that you can file 138 NIA against the person. The delay in sending notice or filing complaint will be condoned.
Fist You receive Notice and than give reply notice with above details and mention online transfer details also ,if you paid morethan principle amount is not legal and you have not mention rate of interst.meet advocate further.
