How to proceed and contact lawyer if cheque issued by an individual bounces. What's the lawyer fees and in how many days we get the amount . Is lawyer fees is also compensated

There is a procedure under section 138 of negotiable instruments act for dishonor of cheque under which firstly you have to send a legal notice to the party n have to give him 15 days for payment n if still he didn make payment then u can file complaint in court for which u will have 30 days time for more information do contact

You must first specify the kind of action that you are seeking against the defaulter. A complaint may be filed under section 138 NI Act that lays down a punishment for defaulter or a 415 IPC may be filed or a summary Suit may be filed for recovery of the money promised by cheque.

I suggest you take up this subject with a lawyer in person. That way you would be able to understand your rights in a better way.

Please contact a lawyer and the lawyer will issue a Legal Notice of Demand to the person who is accused of bouncing a cheque given to you. The notice time will be 15 days. In case the accused persons returns your money within 15 days, then the case is solved. In case there is no reply from the accused person, you will have to file a case under section 138 of the N.I. Act through your lawyer to recover your money.
