What is legal remedy against Cheque Bounce

I had promised to give a loan to my cousin; and issued a PDC. But due to circumstances i could not acknowledge the cheque and now he is falsely framed me in cheque bounce case and sent me a legal notice. What to do?

Legal notice in cheque bounce case is the first step taken by any person whose cheque has been dishonoured and has received a return memo from the bank. It is advisable to reply such legal notice at this stage only. For further help contact me.

Do not give a reply to the legal notice without any legal help as the reply to legal notice will be treated as admission.
You may have to contest your case to prove your innocence.

You shall reply the said legal notice immediately. If he file a case under section 138 NI Act then you have no other option but to contest the same. They will have to show the liability against which you have given the cheque to him, so don't worry hire an Advocate.

Hello sir,

By going through your query and trusting your words i suggest you to reply against the legal notice and write all true facts as you said in query because your cousin or whom so ever that person is will not be able to proove that why you have given this cheque to him because he has no evidence he is on default . So reply with all the facts by which you will be on safer side . So that if that person files a case against you then you will be able to reply in the court as well that why you have given the PDC to that person. And you may also file criminal case againg that person as he used the cheque .
