What can I do in case of a cheque bounce case

maine blank cheque de ke apne friend se 1 lack byaj pr liya tha aj se 1 saal 7 months phele .jiski byaj 7% thi mai ise har month 7000 byaj bhi de raha tha .but january 2016 se maine byaj band kardi bcz mera loss ho gya business mai isse kaha ki tu mere se instalment le le.but isne kaha tere paise 28000 4 months ki byaj aur lah gyi hai.mujhe cash chiye sab no instalments .mera bahut aacha friend hai ye but kisi ne ise kya bola kya advice di isne mere cheque pr 410000 ka amount bhar ke bank dal diya aur vo bounce ho gya.mujhe apse ye pta karna hai is case mai kya karu please tell me

If you have proper written agreement between you and your friend and have the photocopy and details of the cheque and instalments given by you then you can take legal action against him.

Abhee aap uski taraf se legal notice ka wait Karen wo Milne per uska jabab kisi advocate ke through dekar saari cheezen mention Karen. Agar wo case dalta h to yehi defence len. Galti to aapne ki h per uski galati se defend your case with help of good lawyer.

you have issued the cheque so primafacie case is against you little bit. The burden to prove that you are innocent lies upon you. The amount and date must have been filled in the cheque in some other persons handwritting. if the cheque is issued as security or interest it does not attract section 138 NI Act for dishonour of cheque. You have tell that whether you received the legal notice under 138 NI Act if yes immidietly contact an advocate an reply accordingly. As you are saying the proposed complainant is your friend try to settle the matter out of court. Detailed opinion can be expressed only after the perusal pf the content of legal notice.
