Undated cheque against loan can I file cheque bounce case

I have undated cheque and a undated promissory note from a party. Cheque and promissory note has been written and signed by the party itself. Now against party is not making payment. Can I fill the date on cheque and get it bounced and then go to court under sec 138 of NI act, and can I fill the date as per the requirement of PN!? And in such case whether my promissory note will be considered as legally enforceable debt.!!?

Please bear in mind if your cheque is dishonored it is an offence under 138 NI act. You need to send a legal notice first demanding the amount in case of a cheque bounce. In case the other party fails to reply then you can file a case against the other party under section 138 of NI Act.
