Should i take back cheque once the case has been settled mutually

There was one one cheque bounce case against me. Case was registered. But the other party and i both resolved the issue before first hearing. He gave me order copy of cancellation of case. I told his lawyer to return my bounced cheque , he said now that cheque is of no use and that bounced cheque cannot be entertained in court. Is he right ??

No, he cant use the same as original is annexed with the judicial file and if he withdraw the complaint by giving a statement that the matter is resolved with accuse and he is settle with amount .,., this kind of matter must be settle through court , which is most secured play.,., you must do some writing work or pay through cheque ., to avoid future litigation.,,
