Refund of security cheque given by company bounced what action to take

I worked in a software company where i have paid Rs.1 lakh as a security deposit in which he returned me Rs.82,500 in monthly installments for a period of 1 year. The Remaining Amount Rs.17,500 he has given me cheque which got bounced and now when i went and asked him he didn't reply. I even collected Memo from the bank.Now my doubt is whether can i proceed in consumer court,if yes how much time will it take the case to get solved and one more thing can i put on case on the person who signed the cheque or should i put on it on the directors of the company. plz let me know the procedure?

File a case under section 138 n.i Act in the court first send the legal notice, and it will take not more than 6 months to recover your money because director it self can be liable if he has issued the cheque either from his own account or from campany's account.

You must first ask them to settle the account immediately or send the mandatory legal notice to the Company and the managing Director. When a Company is involved in a cheque bounce and you want to make the director a party then you must be able to prove that the person is responsible of day to day activities of the company and that the finances were in his control at the time of issuing of cheque. If your claim is not settled within 15 days of the receipt of notice by the company you should file a complaint under section 138 of the NI Act.
