Received summon from court under charge 138

I have received summon from court under charges 138 and 141. I was employed with Moolchand hospital, new Delhi from 1st Oct 16 to 14 Oct 16 (only for 14 days). After that I left sending mail of resignation. As per the an undertaking/agreement if I discontinue my job before 24 month I have to pay 100000/- and 50,000/- if 60 days notice period not served. I deposited 2 check of said amount to them at the time of joining which get dishonoured as I put stop payment for these checks. Please advise what I should do now as working their was like prisoner and lots of mental harrashment.

Hire a good Lawyer who defend you before the court for any further information pls contact is us at the earliest the court you have to bring your side of the story before the court otherwise ..this is a criminal offence so take it seriously

Has the hospital authority served upon you any legal notice pertaining to the dishonour of the said cheques? If no, then the case under section 138 is not made out. If yes, then you will be liable to pay the amount. However, nothing can be specifically suggested without looking at the agreement signed by you. It would be better you meet a lawyer show him the afreement and the notice served for a better advice.

i have read your question , you have recieved summon from the court of 138 and 141 NI ACT from the side of moolchand hospital due to there reason that you have not served the notice period of 60 days as per your agreement which you have signed and in lue of which you have deposited two cheque of 1 lakh 50 thousand which you hav estopped frfom the bank.
in this condition you have to fight the case in court and you have to give your prooof in court .

Did you raised your voice regarding your problems at Moolchand Hospital ? Or you gave hint to any of your friend working over there. Any evidence that you were treated badly there ? Please dont worry. Just fix an appointment to meet us with your appointment letter and other official documents i.e. resignation let. Let us examine your document to find out a legal remedy for you. Please note, even if you have send directions to your banker for stop payment of the issued cheques, but after issuing such cheques to your company, you are liable to pay for the same. You would have consulted some one before submitting your resignation.
