Punishment for cheque bounce case u/s 138 NI Act

What if a person commit offence under section 138 due to insufficient fund?? and if person refuse to pay amount after his offence has been punished

You need to send a legal notice of 15 days statutory period to the person who gave you the cheque within one month after the cheque gets dishonoured and thereafter to file complaint case after the lapse of 15 days period of legal notice. However it's a bailable offence and the punishment for it is maximum of two years with fine

For proper opinion you have to share the copy of that order whereby punishment has been given by the court. The order itself contain the factum of the matter. Further 138 NIA is quashi criminal case in that way along with money punishment is also awarded subject to gravity of the matter.
