Procedure for Cheque Bounce in case there is no photocopy of cheque

Sir, meri salary k do cheque bounce ho gaye hai . Ab mere pass vo cheque ya usaki photocopy nhi hai . Lekin bank statement hai . Kya koi karywahi ho Sakti hai .ya meri salary mil Sakti hai.

Dear Sir,

As per the infromation provided, you have two options. First, you can file a criminal case under section 138 NI Act but in your case you have lost the original cheque which is mandatory for filing the case.

So secound thing you can do is, you can file a suit for recovery of you salary alongwith intrest from your employer.

If the cheque has been lost by the bank then bank is responsible for the same as it has been held in the Revision Petition No. 649 in the matter of ICICI Bank v/s Shri Sonnegowda & Ors , decided on April 16, 2012. However, if the Cheque has been lost by you then you must lodge an FIR with the police station pertaining to the loss of your cheques without loss of any time and send a legal notice to your employer.

Yes, if u don't have cheques, still suit for recovery can be filed against the company on the basis of the bank statement. If the cheques can be made available then Cheque bounce case can be filed.
