Person borrowed money and gave 2 cheques which have been dishonored

One person borrowed money from me and given two cheques. I have requeted him several times for return my money,but he was not responded.He borrowed money from many candidates.I think now he was planning to go for insolvency petition.What can i do,can bounce one cheque first and file a suit on him.Can i bounce second cheque for same debt remaining recovery of money.Or Two cheques at once.If he is taken insolvency petition before cheque bounce what is my position.My friend also given him money.Can we both file suit on him jointly with same lawyer.Normally how much time taken for cheque bounce case.Our religion hindu & debtors religion also hindu.

Particulars furnished are not clear. What is the amount that was lent by you and your friend. Whether at the time of lending of amount have you obtained any promissory note. Whether your friend also obtained promissory note. You must engage an expert advocate who deals in cheque dishonour cases and civil suits. Whether the person who borrowed amount has any assets. If he did not have any assets filing of civil suit will be a waste of paying court fee and other related charges. You must file two Cheque Dishonour cases separately. You must file two cases on two cheques that are going to be dishonoured. Two punishments will be awarded to the borrower and double the cheque amount will be granted to you in both the cases. You and your friend will file cheque dishonour cases separately very quickly before the borrower filing Insolvency petition. You and your friend must file separate cases as soon as possible. Insolveny proceedings will not rescue the borrower, but you must file cheque dishonour cases earlier to his filing of insolvency petition.

Dishonour both the cheques file criminal complaint for cheque bouncing.
You can also file civil recovery suit at the same time and ask for attachment of property before the suit can be decided.
your friend can also file complaint separately. The same lawyer can file all the complaints against the same person.
