I was having a travel party.they paid me 37000 to visit a place but unfortunately tour was not done. at the time of refund I have refunded 20000 out of 37000.but now i m unable to refund as my financial condition has become too weak.but I will refund the rest within few days.i gave them a cheque also which bounce due to insufficient fund.now they are not ready to give me time.what shall I do.please suggest.
If the party willing to file 138 case against you then they have to serve you a notice prior to the same and during the course of you can reply to them that you shall pay off the money either in one shot or in instalment . Now it is up to them whether they will permit you or not. If they file complaint case against you in that case also you have to take the bail from the court and place the same story of refund before the court.
Does the case is lodged by them.....???
If not then tell them to compromise, if they don't then let them do what they want.

You may either seek time for payment by giving a letter or notice or you may wait for what action is taken by other side. If they file any proceeding u/s 138 N I Act, you have to defend the case. You may counter their charges.
I understand that you really wants to repay the balance amount, but due to financial problem you did not able to repay the same and you asked for time from them, which they did not provides to you. On the other hand, you already issued one Cheque, which was bounce due to insufficient of fund. Now I don't know whether you received Demand Notice or Not. If they send demand Notice and you received the same, then within 30 days after 15 days from the date of receive the Demand Notice they shall file Case against you before the Ld. Court. In this situation you will definitely get time for getting fund.
