Hi.. my parents borrowed money from my relative and gave them without my knowledge a blank cheque which was signed by me and I was supposed to give the cheque to another person.. later I came to know this and closed my bank account. Now Incase if they produce the cheque at bank.. what will be the result? Does it effect me? Is the cheque valid? How to overcome this?

You have committed a mistake of issuing the cheque. If it is presented within its limitation period and bounced, you become liable to be prosecuted under Section 138 of Negotiable Instruments Act unless you prove that you were not liable to pay them the amount. A cheque bounce case may be filed against you. Merely closing the account does not absolve you of your crime. To overcome this, you pay due amount to your relatives and obtain a receipt for that.

instated of closing your account you can give a notice for stop payment, in case if they produce the cheque going to bounce and then A cheque bounce case may be filed against you. their are two ways to over come on this 1st , try to talk to your relative and request them not to honored cheque close the loan and take back the cheque or tell some reasons and take back the cheque. 2dn option by legal way once they file a case then court ask the reason for bounce at that time you have to explain the reason but chance are very limited that you can wine but you can fight back with proper proofs. if you not utilized that amount which your parents are take loan .
