Legal recourse when charged under S. 138 of the NI act


20-Jul-2023 (In Cheque Bounce Law)
I had issued a cheque as a Director of my Company to a party  which got bounced in 2016, I had requested the party to give me time as I was jobless and moneyless. Still he registered case against me and put me in Jail for 15days. I want to settle the things but need some time, he still trying to put me behind bars again.What legal recourse do I have?

Sir you had not mentioned in your query that what type of case had been registered against you.now if you are in jail right now then you have remedy to apply for bail.afyer that proceed with case

First of all case under section 138 of NI Act is bailable offense and u can not send behind bars untill case is not finally decided. Moreover if u want to settle matter than requested before court that u r ready to pay money as per requirement of complainant and court will definitely consider ur plea.

Hi you should must settell case with complainant party.you will try to convinced them that if they will give you time than you will arrange money.if they will not agree with you than you will try to get permanent bail in this case and fought in court but in these days court are very strict in cheque cases.
