If anybody makes stop payment of chq; in that case still he has to maintain sufficient balance in the account for the chq amt ?

In transactiob if you gave cheque and asked your bank to stop payment regarding that cheque even then you r liable under 138 ni act.onus is upon you to prove that you stop payment because of some reason

Keeping funds in the account while the cheque is presented even if payment stopped, is advused. Because it is a good defence in court that I was keeping funds but i had stoped payment of cheque for some other reason and court may be convinced with your reasonings.
