How to proceed with Cheque bounce on a school

we r running a school in pinjore. we hired a van driver for transportation purpose. we entered into an agreement in which it was mentioned that if we exits the job before one year then he has to pay a penelty of 10,000/-. one day during the tenure, he left the job with no reason and the earlier day we had given a cheque for the last salary of 9,000/-. we stopped the cheque as he didnt gave any notice to us for leaving the job. now he filed a case of 138 and 420. how to get out of it....
As you mentioned there was an agreement between you and him. In your written statement you can show to the court that it was already a clause by enclosing the said agreement. Rest all depends on the prudent mind of the court. Thank you.
