How to file case for cheque bounced before 30 days of bank memo

If the bounced Cheque is more than 30days of Bank Memo then what we can do to filed the case.

Hi,

You should have sent legal notice within 15 days but the notice period has exceeded.

Now you can again get it bounced by depositing the cheque in your bank account and send demand notice through advocate within 15 days of bounced and thereafter within 45 days of reciept of notice file complaint u/s. 138 N.I.Act

Dear Querist
You need to send notice within 30 days under section 138 from date of dishonour of cheque memo.
If permissible cheque may be re-deposited and notice has to be sent in timeframe as aforesaid
If your cheque has become out date and if your cause is within limitation you may file a summary suit.

Actually technically the limitation to file complainant u/s 138 for cheque bounce initiates after issuance of notice within 30 days. Then you will have wait for 15 days when the other side receives the notice. Now here onwards your limitation starts for 30days. But if you jump this limitation you can present the cheque one again and get is dishonoured. But you should not disclose about the earlier bounce else you will loose case.
