how to file a cheque bounce case if cheque given by untrusted man

An untrusted man gave a check of J&K bank. It was bounced on 13july2016. To keep my money safe what sud i do? 1. Can i directly file criminal case against check provider 2. Or i have to send a notice necessarily 3.can put that bounced check again after one month of bouncing Plz suggest me possible way

You have to give notice with in 30 days from the date of cheque bounce. So try to give notice as soon as possible. No need to again deposit the same cheque for clearing in bank it's nkt necessary. If some one time of 30 days has expired then they again deposit the cheque just to condone the time limit of 30 days.

As per Negotiable Instrument Act it is mandatory to send legal notice within 30 days from the date when cheque was bounced giving 15 days time to the person who had issued cheque so in ur case already 30 days have elapsed it is advisable to present cheque again to the bank for withdrawal of money and if it bounces again immediately contact lawyer. U cannot directly file case 15 days notice is mandatory.

The limit of the cheque is 3 months, if any cheque bounces they first you have to send if legal notice within these 3 months and after one month of the notice you can file criminal case of cheque dishonour.
