You get records from bank by filing application under RTI Act. Several people fail due to not properly taking defence. After perusing your records I am able to advise you effectively. I had worked as ACMM where exclusive Cheque bounce cases were there.

Dear Sir,

Please furnish more details regarding the security deposit cheque, and the purpose for which it was issued to you. If the cheque given to you is dishonoured for insufficient funds, then you have the right to take legal action on the person who issued that cheque. Please feel free to contact me. Thanks

Before presenting the cheque you give a complaint with the police stating facts and circumstances and a stop payment to bank that cheques issued for Security purpose later give paper publication narrating facts about it and in cross examination u have to take all above aspect with a good cross examination rebutting presumptions under act.

If you have entered into any agreement while taking loan if it is mentioned in the agreement you can prove other wise MOU or any document which you have entered with the creditor should contain that the cheque is given for security, otherwise if you have given only cheque without any documents means it is difficult to defend that you have given cheque for security.
