How to defend cheque bounce case

i give the cheque to the builder for completing the work in the building with in one year . but he didnt complete the work . after 2 year he submit the cheque to the bank. and due to not sufficient fund in the account my cheque is bounced. he filed the case against me . how can i escape from cheque bounce case ?

Once you have issued a cheque you are bound to pay that amount but as you said builder has not completed your work, you can defend your case. .

It is my best advice for you that if the builder file the case for check bounce on the ground that he received the check from you for complete the particular work and check has been bounce then You will have to bring all the facts before the court where the builder file the check bounce case that why you issued the check and why it has not been paid, other than this you should filed the case against the builder for breach of contract for not completing the work of building and for loss of non completing the work with in time, that will help you from two ways first you can recover your loss and bound the builder for complete the work and second it will help you to protect in check bounce case that what was the reason for issuing the check and you can prove easily that when particular work is not complete by the builder then you are not bound for payment. I hope this advice Will help you for escape from the check bounce case and also will help you for protect your right.
