How to deal with threats of cheque bounce case

Hello Sir, One of my fried took 1 lack from a guy who is involved in betting and give money to play satta in matches, he is having my cheque as guarantee and my friend is not in a condition to pay him his money. Now he is demanding money from me and threatening to file a case of cheque bounce case on me . Would I b published in this case .

Just take a legal advice as soon as possible for sake of brevity otherwise prima facie offense already established against you. Kindly take proper advice from a lawyer or file a complaint before police

Before filling case against you ur take any action against you. You need no give a legal notice to him and asked him to returned the above said cheque so that you can defend your case when he file. Than his case is week.

Yes, if the person who has your cheque files the case and established a prima facie case that you indeed gave guarantee / took the money and failed to repay and if your cheque bounces on account of insufficient funds court can innitiate the process. In case you want to avoid and have a upper hand maintain balance and stop the payment for the given cheque. Let it be returned on account of payment stopped. Then in your defence you can plead that in fact there was no transaction and reveal th truth in front of the court.
Guarantor and borrower are on the same footing though

Since the amount was taken by your friend and not your good self then Legally recoverable debt shall be against your friend. further the manner how the sum was given to your friend will have great bearing on the merit of the case. for e.g.. if the fund was given to your friend by way of a cheque then since credit would show in your friends account and debit entry would show in the account of the person for the same transactions who had given the loan , no liability in such scenario can be affixed upon your good self.

Please dont worry. Let the person lodge complaint against you in cheque bouncing case. Its very easy to file a case but very difficult to prove the same in the court of law. You hire a good advocate.
