How to deal with cheque bounce

Customer given 10000 Rs amount cheque . but already one time bounced last month. He telling I will give u will give but no use. can I represent cheque and how can i get my amount? What will be do Next?

Dear sir,

Please confirm from the costumer before representing the cheque, make sure the costumer has enough balance in their account. If the cheque again bounces, then you need to take legal course to recover the money. Contact for further discussion.

See the date on the cheque, the cheque is valid for three months from the date written on it. You can present it any number of times before that date. Then if it is dishonoured even on the last opportunity take legal action.

Dear Sir/Madam ,

Under negotiable instrument act 138 you can file a criminal case against any person who issue an instrument and donot honour it beside criminal there are civil remedy avaliable under law,

You need to send legal notice to the drawer of the cheque within 30 days of receipt of memo for cheque bounced.
then wait for the reply from the other party for 15 days and after expiry of 15 days you can file the case with the concern court within 30 days of expiry of such period.

Deposit the cheque in your account and get it dishonoured. Give notice u/s.138 and after waiting for statutory period file complaint u/s. 138 of negotiable instruments act before magistrate court having jurisdiction

Accept the cheque for your dues from that person, duly signed ,for the current date drawn in favour of you and then deposite the said cheuqe in your account and if not cleare in the due time send notice for the dues and after 45 days of your notice date if money is not given to you you can file case against him for your legal dues U/S-138 N.I.Act

3 months is the max time limit. Dear queriest. To make a person liable under instruments act you have to call upon notice to the other person and ask to pay full and final payment. If he still not want to pay the dues you have the option to move to court. Thnks

Hello , since it relates to the filing of complaint againt offence of cheque bouncing, therefore there is no specific time limit for it. But you can always expediate with the proceedings by getting summons and warrants etc served to accused on time and the matter may b decided soon. Though time frame can not be mentioned but if your case is good and the accused may offer you money when he reached court for first time.

Cheque has time limit of 3 months and after that it can't be used . This is your maximum time limit to get the payment against cheque. If still it is a blank cheque it is advisable to use it in 3 months as it is difficult to prove the case.
