Do you mean that the person who issued the cheque is not residing in India now? When he issued the cheque where was he? What is the transaction? How did he issue the cheque or was the cheque was as a security cheque when the person was in India? Kindly contact me and give me all the details. We can file a cheque bounce case and make him come to India for the case.

the cause of action should be at any place in india to file cheque case. your question does not contain as to any details regarding the transaction. section 178 Cr.P.C. speaks that even if a part of cause of action arose within the jurisdiction of any court in india, that court would have the jurisdiction to entertain the complaint.

The Negotiable Instruments Act are applicable to Indians sir. if the cheque bouncer is living abroad after committing the offence under NIA, the court issuing Warrant to arrest him could not be executed. For there is separate proceedings.
