Gave cheque as security for settlement in a civil case

Sir/Mam Hi, In 2011 I gave my cheque As Security during statement between two parties in civil case (compromise) and it was written on the back of cheque word As Security which can seen by necked eyes.After 3 yrs I received bailable Warrents at my village that an 138 cheque bounce case is pending against me.I received the Warrents and got bailed.while trail the complainant cutted the word As Security written on the back of cheque my counsel file an application u / s 466 but he withdrawal it without telling me. Even the person didn't gave his evedence for I had given that cheque of Rs.3.5 lac.That time an affidavite was executed as compromise and all facts were written on it but that all are not present with me still I am searching the same. I got convicted with composition 8%per annum. Now we have moved an application u/s 340 Crpc and 193 IPC as I have certified copy of cheque Ex c- 1 in which it is written As security on the cheque.Now I wants to now how can I prove myself. Thanks

Your case seems to have been mishandled. You must lead additional evidence in the matter by filing an appropriate application before the appellate Court along with the appeal and argue or reversal of the the conviction order.

The word mention you on cheque and compromise deed itself is a fact and evidence which needed to be touch by the court but never been got touch, and not disclosing of things are amount to concealment of fact, court definitely consider the things.
