Cheque Payment Stopped By Company

Hi, I resigned last month from my company and got my last month's salary as a post dated cheque, when i went to bank today they told me that my cheque payment has been stopped by the company. Can I send a legal notice under section 138 to the company to pay me that cheque amount in 15days? if not what steps should i follow to sue the company.

Yes, you can send them a notice under section 138 as stop payment is covered under it. Since they issued a cheque it is assumed that they owed you the money. If they do not pay you must file a case under 138 following the procedure there under.

Dear client,
Present cheque into bank for realization, if not cleared, take memo along with original cheque from bank and then send legal notice within15 days. If payment not made in those 15 days file complaint before ld. Court having jurisdiction.

YOU MAY SEND THEM A LEGAL DEMAND NOTICE FOR PAYMENT OF CHEQUE AMOUNT WITHIN 15 DAYS, AND COMPANY FAILS TO PAY WITHIN 15 DAYS, THEN WITHIN 30 DAYS OF EXPIRY OF 15 DAYS TIME, FILE COMPLAINT U/S 138 NI ACT
