You can send legal notice to the accused within 30 days from the date of cheque bounce by threatening if not paid amount within specified time mentioned in this notice, usually 15 day time will be given to comply by paying the cheque amount. If, not paid within 15 days, the complainant have time to file criminal case against the accused within 30 days. So, you can claim cheque bounce case by filing the case u/s 138 of the Negotiable Instrument Act.

Statutory notice has to be issued within 15 days of cheque bounce and demand the issuer of cheque to pay the cheque amount, if he/she fails to pay private complaint has to be registered within 30 days. Suit for recovery is also maintainable.
