Cheque issued but signed by third party, is it valid?

Dear All, I have issued my spouse cheque to one person by signed by me , is it cheque is valid

Yes. you will be in trouble. Better you take preventive steps like lodging cheque missing complaint with police and instructions to your bankers that you have lost such cheque. If you take lightly you will be trouble. Immediately contact a lawyer and issue legal notice.

First the person present cheque and issue notice then u have to take contention that The person has stolen cheque from your house and has signed the signature to cheque which belongs toto your spouse thing that the cheque belongs to you and he takes contention that you signed the cheque and files dishonour of cheques cases against you since when cheque does not belongs to u section 138 does not attract so cheque is not valid so u have to build a good case from reply notice since it attract 420 of IPC. Think and get good Advocate as two cases comes out of cheque .

Rather then asking about its validity, you have to be cautious for what you have done. The aggrieved person can file a case of forgery, cheating and breach of trust against you. Your signature may be sent to Forensic lab for identification and you will be held liable for cheating a person by misusing your wife's cheque by putting your wife's signature you have committed a fraudulent act and you will be known as fraud.

No. it is not valid cheque. When cheque is issued the cheque should be signed by the person who issues his/her cheque. In your case cheque is of your spouse and signed by you. So it is not valid cheque.
