Cheque dated last year bounced we came to know about it today

Can I file criminal case against cheque dated 18th & 20th October 2017 was dis honoured due to insufficient fund on dated 19th January 2017. The cheques were bounced already for the same reason, 2nd time had deposited the same on above said dates were been bounced due to insufficient funds. Please advice how to move forward step by step and the charges levied for the same.

Assuming the cheque is dated 18 & 20th OCt.2016 and you have the return memo dated Jan.17 you have a good chance of filing the case. You have to immediately send a legal notice ie within 19th feb.17 to initiate legal proceedings.

Yes you can file a suit , immediately consult me to sending notice him for repayment of money against cheque bounce. Within 15 days , you have to file a case. Consult immediately and send notice. This is right time to get back your money.

First send legal notice to accused ,if he is not complying the notice matter,when receipt of the notice ,after lapse of 30 days ,will fileu/s 200 of credit.p. for relief punish u/s 138 of Negotiable instruments Act.

If cheque presented within 6months from the date mentioned on it then you can present any number of times as you wish
But once notice issued and served to accused you can't re present the cheque for 2nd time

Collect return memo from bank
Issue statutory notice
Get postal recepts and file complaint with in 35days from the sevice of notice

The procedure is: Deposit the cheque and if it bounces by the Bank, that is it is returned as "insufficient funds", then Bank will give you the endorsement. Within 15 days of receiving this endorsement, a legal notice must be sent to the defaulter giving him 30 days time to make the payment. If within 30 days he/ she does not make payment then you can proceed with filing of a Complaint as per the Negotiable Instruments Act. For legal fees, please approach a lawyer in person.
