Cheque bounced on in January this year. What are my options

One of my customer gave a cheque and tell us to hold for a while and we submitted that but it bounce back lack of fund. we try to contact him till now he said money will give in hand but still no further improvement so we decided to log a complaint against him Please help me the procedures. In this case the cheque we submitted and returned in April 2017. more than two month before is it any possibility to submit case

Hai.

You dont have many options. Proceedings under negotiable instruments cant be proceeded being delayed. Now u may either file 420 cheating which weaker for u to conduct. He only window before you is to file civil case for realisation of money. But u still need to remit a gud amount say about 6% f the cheque amount as court fee n other charges.
anyhow if u want to initiate proceedings do contact ur lawyer fast.
also if u r sure enough to bring him the place where u says. V can lodge a PLP to settle the matter but his co operation is required.

Produce the same cheque in the bank once again and get it bounced. After that you have to sent a legal notice under section 138 of NI ACT asking the defaulter to pay it within 15 days and there also if he fails you have to file a complaint under 200 crpc in the concerned jurisdictional Court
