Cheque Bounced in Partnership Dissolution

25-Sep-2023 (In Cheque Bounce Law)
I sold my share of my partnership business to my other partner. He gave me a cheque for the same. However, no dissolution agreement was signed. I sent him many mails regarding the dissolution and also sent him formats for the same. At last, I made an affidavit stating my resignation and all other things and published a notice in newspaper. Now he has emailed me that dissolution was never made and we were only discussing things. He has asked me to shut down the business and bare the loss. I have already left the business 2 months back. Since I have already got the cheque and deposited it in bank and it get dishonored. Please suggest me ...

You can file a case for cheque bouncing and initiate legal proceedings. If notice has been published in newspaper by you, you stand retired from partnership business and as such seem to have a good case.

You have the right to file a case for cheque bounce in criminal matter court and dissolution for civil court. your responsibility is no more till your resignation. You can deposit cheque in your bank and after bounce you must give notice to your partner within 30 days of bounce date or date of knowledge of date then within 45 days file complaint against your partner.
