Sir time is the Essence in cheque bounce case as you have given cheque to hdfc u can demand back same from same bank . N u have to present cheque again and if it bounces again send legal notice to the person within 30days from date of dishonour giving him 15 days to pay your money failing which u can file criminal complaint

The time limit in case of cheque bounce is you have to send legal notice with in 30 days from the date of memo of bank in which the reason of cheque bounce is mentioned. You give 15 days time to party for your payment from the date of receiving notice and if the party doesn't give you money with in 15 days then you have to file a complaint under sec138 N.I act with in 30 days. If your time period if notice is expired then again deposit the same cheque in bank so that your time limit again start from the date of fresh memo of bounce.
