Cheque Bounce Joint Memo what to do

As per joint memo the accused has not paid the amount. We had put a clause saying if not paid the agreed amount in 3 months the accused has to pay full cheque amount. Its been 6 months the arrest warrant also issued but the police is not taking any action. Is there anything we can do legally now? My lawyer asks me to tell the police to return the warrant. But the police is not listening to us. Please guide.

Insist the court to get back the warrant and reissue. Better write letters to higher authorities police and judge. They will certainly execute and put him behind the bars. Better not take advise of your advocate because he wish to in the good books both.

I should read the joint memo. what your advocate who was in that case doing ? you can consult him. i f he is not available I can help, but if the matter is in Bangalore. Also , if the amount is less you can also file civil suit.

When once matter settled out of court and accused not paid amount take action by fine levy warrant through commissioner through court since admitted by accused and he has to pay it get arrested him or send him to jail or to make payments

it is duty of the state/Police Officials to execute the Warrent, if the Police officials intentionally avoiding to execute the warrent, then Warrent may be execute through higher officials of the Police Department, then also, they are not executing the warrent, you have option to file Writ Petition before the Hon'ble High court, for issue direction to the state, as state police officials being the public servant, they are not obying the orders of the court, then High Court will give direction to the higher rank official of State, then Accused will be arrested.
