Cheque Bounce Due to signature Difference

Sir my wife filed cheque bounce case due to signature differs against me for cheque issued by me under section 9 order. In her statement during cross by my council she stated in Honble court that 'It is wrong to suggest that the cheque in question was issued against legal liabilities of the accused. Kindly suggest how to treat.

Sir, the statement of the complainant could be treated in positive sence also. Which on interpretation depicts that the cheque issued by the accused was not liability of the accused. Secondly the signature also deffers from the original. Which can be proved that the cheque issued was not really issued to the accused. And she has manipulated the contents as per her demands required to harrash and exaggerate money from the accused only.

Sir, in this case, firstly, you can simply argue that you are not in capacity to check the signature that the cheque in issue needs to be cleared by the bank and it was just mistake of fact your intentions was not mala fide or malicious, and as she filed this case now i am not willing to pay the amount to her. Secondly, you do not have any problem in giving money to your wife and as it seems that you both are separated and you are paying the maintenance amount, hence if you are willing to payn the amount you can pay the amount to her and clear the legal burden of your head.

Sir, your case is fit for aquittal on the basis of admission in cross as you mentioned above. Because in cheque. Bounce case the burden of proof is on complainant to show legal liablity and in her cross she blantly refused
