Cheque bounce claim on company of which I was director.

A company was registered with me and my boss name as directors. He was taking care of everything and I wasn't involved in day to day transactions. He some service from someone on behalf of the company and gave him cheque signed by himself which bounced. Now I have received notice and summon from court as I complainant has made me accused as well as I was also registered as director and working there. Please advise

You have been made an accused in the present case due to the procedure of law. Each and every director has to be made accused. You may bring evidence on record to show that you were not active for day to day affairs of the state. after a few judgments by delhi high court, it is mandatory that complainant has to state that accused was responsible for day to day affairs of the business.

You might have received a legal notice under section 138 Negotiable Instrument Act. You are supposed to send a legal reply to that legal notice within the time stipulated in that legal notice and mention all the facts in your legal reply.
