Cheque bounce case filed in court, accused not appearing in court

We filed 4 cheque bounce cases against the same person since June 2016. I live abroad and as per my lawyer a warrant has been issued in his name but he has neither bothered to show up at court nor try to get a bail. My lawyer tells me that everything will be fine and he will come to court and return our money. I don't know what else to do from here other than believe in my lawyer. Do these cases take so much of time and can the opposite party not even be bothered to show up. What should I do?

Definitely, these case do take up a lot of time. A lot of times, the accuse does not appears and the matter is frequently adjourned for the next dates. This must be a bailable warrant, which the Court must have issued against the accused. Even if this warrants, fails to secure the presence of the accused in the Court, the Court will finally issue a NBW and then the police will bound to arrest the accused and secure his presence in the Court. Until that happens, the matter will go on at this pace only.

If ur opposite party address is right and notice serve them andhe receive then he is not present in court court issue N B W Aginst him so first u see notice serve r not.so call ur advocate and ask for notice report summited before honble court r not

In NI act Cases court should decide the case as soon as possible but due to various reasons it cannot be possible but every court and lawyer try to do to decide the case expeditiously. In your case if accused is not appearing before court, your lawyer may request to court to issue nbw and after that he may request to court to pass a order to attach the property of accused. Your should clear all the proceedings from your lawyer.

It is not true what you. If warrant issued and accused not coming to court then there are another steps. Ask your lawyer to get nbw issued against the accused. In that case police will be duty bound to arrest the accused and produce before court. If police is not doing this still there is ways as to get a notice issued against SHO of that thana. In case of need u may call
