Cheque bounce can father property be claimed for recovery of money

I have given 400000 rs to my friend for 2 months and taken a return notary on 500 rs stamp and i have 2 blank checks only his sign on checks of his bank account Now 1 month is passed 1 month remaining to end validity i have given him to return back my money But now i noticed that his financial condition is so bad he will not able to return my money Then if i file a case against him by bouncing the checks after 1 month under sec 138 then what will be the courts decision because he didnt have any own property but his father have agriculture land so can court give back my money by aquire his fathers property?

There is two type of cases in cheque Bounce matter
1 case of criminal nature. in this case he will be punished and check amount as well as compensation amount will be provided to you by Court
2. Another cases of civil nature in this case after deciding of it we can approach for his property

The matter will have to be instituted in court after bouncing the cheque
And then it will have to be contested and if proved then he will have to either pay or sit in jail...
