Cheque bounce against builder how to proceed

Dear Sir/Madam, I booked a flat in Bangalore in pre-launch offer I paid him 15 lacks, but the builder did not start construction even after 7 months. So I cancelled the agreement and builder gave me 3 cheques of Rs 16lacs with 1lac int.But the cheques bounced (and i dont have agreement papers even xerox)we approached the court and he is escaping without accepting summons. However later with the help of police we made an agreement with the builder for another project with 60% completion that agreement will be cancelled once he returns the amount. But neither he is giving money nor accepting court summons. Please advice your best solutions, I am without job for almost 14months and I need to take care of my family. Please suggest how to proceed.

You have two options: one civil and another criminal approach. For criminal approach, you need to file a cheque bounce case in magistrate's court within the limitation period and for civil approach, you need to file a money recovery suit in civil court.
