Can I file cheque bounce case five months after it was dishonored

I expected sbi check of rs 12000 from one of my clients the check got bounced in november 2016 .it is five months now can i still lodge a complain aganist check bouncing charges the check got bounced in novmber

No you could not initiate cheque bounce cases on the basis of cheque that has got dishonoured more than one month ago. If the cheque has got validity period of 3 months from the date of issue you can get the cheque bounce again and issue notice . in your case you can go for 420 case.

Normally a Cheque is valid for Six Months. But in some Cheque of several Banks we can see that the Cheque is valid for 3 month (which is printed in the Cheque). In your Case, if the Cheque is not printed for 3 months. Then you can try for dishonour the Cheque once again. and if it dishonoured Then within 30 days issued a Demand Notice through an Advocate otherwise, your said Cheque became valueless one.

No, you cannot file case after expiry of one month from the date of cheque bounce against any person before the court of law. But there may be another way. Please contact with me alongwith all documents I will suggest you.
