Can i file a case on behalf of my husband

Hello sir greetings, sir actually a person have to give 68k for us, he gave cheques in the name of husband all the cheque got bounced 3 months back itself, v spoke with him he said he ll settle soon still he didn't. Now in the hand I m having only one cheque in the name of my husband. My husband is out of country. Shall I bounce it and may I put case in the name of my husband?

You should deposit the cheque which is in name of your husband and get it bounced. The procedure is that once you get to know the cheque has bounced collect the memo from the bank and send a legal notice through a lawyer to the person. Then with in 15 days if he does not pay the amount you are liable to file a case under section 138 of Negotiable instruments Act within 30 days of sending the notice. For the remaining 2 cheque you can file a suit for recovery of amount if the limitation period is over for N.I. Act
