Can Bounced cheque case be filed through power of attorney

Cheque favouring my daughter has been bounced due to insufficient funds . Daughter is living at Bangalore and cheque bounced at Lucknow. Can I(father) with Power of attorney from daughter can sue defaulting party(Builder). Personal of appearance of daughter is required or not

The complaint under section 138 of N.I.Act can be filed through power of attorney holder. You can file complaint on behalf of your daughter. The power of attorney must be carefully drafted. Similarly the complaint also needs to be well drafted.

Yes you can filed your complaint against the defaulting Party. And there is no need of your daughter while you will file the complaint, there will only necessary present to your daughter while she gives the affidavit for proof the transaction between she and opposite party while the Magistrate take the cognizant of your Case.

Dear Concerned, Yes a special power of attorney given by your daughter to you to pursue the legal proceeding in reference to the cheque bounced can be pursued by you. the speacial power of attorney need to specifically mention the details of the case along with giving you authority to file and plead on behalf of your daughter.
