Bounced cheque from builder

I had booked a property in panvel, Maharashtra. However, since in last 2 years no construction was seen, i decided to cancel my booking and ask for a refund. The total amount i paid was 344000. The builder has given me post dated cheques of rs 300000. However, the cheques have bounced twice. Please advice me the legal options i have.
You have options to file cheating case u/s 420 and criminal breach of trust u/s 406 of IPC to send him behind bar. Whereas to recover money you can file cheque bounce case u/ s 138 of NI act. If you want your money along with compensation you can go before consumer court to get money recovered along with compensation amount, I will suggest this one ....
Since the cheques have bounced you can initiate proceedings under section 138 of Negotiable Instruments Acts, 1881.
