Being wrongly accused in cheque forgery case, what steps to be taken

Case is on cross and now accused is person who signed on cheque , now his advocate is telling judge that cheque is of other person and I have forged accused signature . where as accused has taken somebody cheque and signed himself and given cheque to me. In cheque name of whose cheque I it is not written what can we do
The case under 138NIAct is admitted mlybin the name of the Person signing it. In the evidence you have to prove that theque was issued from accused's bank account. If not, you have no case and your complaint would be dismissed.
