Who get the provident fund amount after husband's death
23-Apr-2023 (In Banking / Finance Law)
Hello, I am posting this question on behalf of a friend. My friends husband passed away at the age of 35 due to an heart attack. While she is still on the state of recovering from the shock, her in-laws are locking down on their deceased financial matters. My friend is not employed and has a special child (cerebral palsy) and the child is 4 years. And she does not having any monetary inflows. The PF account of her's husbands - who gets the money? is it his parents / wife. I do not have the information on who he had nominated when he joined his first job. Please help.
If her husband has not nominated his wife it is better to file an objections before the PF office not to release the PF fund. If her husband already nominated with draw the money at the earliest.
If the Nomination is in his parents name u will have to file a suit seeking PF benefits in the wifes and children name. Each shud be entitled 1/3 rd share, i.e mother, wife and child.
